Responsible body

Purposes of data processing and legal bases

QIAGEN processes your personal data for the purpose of conducting the application process on the basis of Art. 6(1)(b) GDPR. This processing is necessary in order to decide whether to establish an employment relationship. In addition, QIAGEN stores your application data for up to twelve (12) months after completion of the process on the basis of legitimate interest pursuant to Art. 6(1)(f) GDPR. This allows QIAGEN to consider you for future job openings. You have the right to object to this storage at any time. In this case, data will be deleted immediately, provided that no legal retention obligations apply. Processing for statistical purposes is only carried out on the basis of voluntary information and consent. You can withdraw consent at any time by contacting QIAGEN as indicated in the “Contact” section below. QIAGEN does not use automated decision-making or profiling in the recruitment process.

If QIAGEN processes special categories of personal data (e.g., health data, diversity information), this is done under Art. 9(2)(b) GDPR for employment law obligations or based on your explicit consent under Art. 9(2)(a) GDPR.

Data access and transfer/third countries

Your data may be shared with internal HR teams, hiring managers, and authorized staff within QIAGEN Group. External service providers (e.g., IT hosting, background check agencies)  act as processors in accordance with Art. 28 GDPR. As part of the application process, it may be necessary to pass on your application documents to other companies within QIAGEN Group. Some of these companies are based outside the scope of the General Data Protection Regulation (GDPR). Where data is transferred outside the EEA, QIAGEN takes appropriate safeguards in accordance with Art. 46 GDPR to ensure an adequate level of data protection. This is done in particular by concluding EU Standard Contractual Clauses of the European Commission or comparable contractual arrangements.

Background Checks

As part of certain procedures, QIAGEN may collect relevant information from publicly available, work-related sources (e.g., LinkedIn). Data from purely private sources (e.g., leisure networks) will not be taken into account unless it is absolutely necessary in exceptional cases. In addition, QIAGEN reserves the right to view proof of identity and references and to check them against EU sanctions lists, insofar as this is legally required or necessary to establish an employment relationship (Art. 6(1)(b),(c) GDPR). You have the right to be informed about the data used, to correct inaccurate information, and to express your point of view.

For positions in the US, background checks are carried out as standard during the recruitment process by an official, external, and certified partner.

Storage and deletion

Application documents are deleted after twelve (12) months following completion of the selection process. Retention periods are based on our legitimate interest in considering you for future roles and statutory requirements. If QIAGEN contacts you again as an applicant in connection with another job vacancy, the retention period for your application documents will start again. This applies if further storage is necessary to carry out a new application process and the purpose of data processing is expanded or redefined accordingly. The new period is based on the usual deletion period of up to twelve (12) months from the date of renewed contact. You have the right to object to this storage at any time.

What is special with job openings in the U.S.

Please note that the above provision does not apply to job postings in the U.S. and any applications to job openings in the U.S. for legal reasons; in this case, we retain the data for a period of up to two years in compliance with applicable U.S. regulations and to address potential legal obligations, as well as for the purpose of contacting applicants regarding current or future job opportunities. After this period, the data will be securely deleted.

Your rights as a data subject

Under the GDPR, you have the right to access, rectify, erase, restrict processing, object to, and transfer your data, among other things. You also have the right to lodge a complaint with a competent supervisory authority.

QIAGEN – California Applicant Notice at Collection

 

Thank you for applying to QIAGEN or one of its affiliates, subsidiaries or related entities (“QIAGEN,” “we,” “our” or “us”). This California Applicant Privacy Notice (“Notice”) supplements QIAGEN’s Privacy Policy and applies only to individuals that reside in the State of California who are job applicants (“Applicants”) of QIAGEN.  This Notice is intended to comply with the California Consumer Privacy Act of 2018, as amended from time to time including by the California Privacy Rights Act of 2020, and any implementing regulations adopted thereunder (collectively referred to as “CCPA”). Terms (including defined capitalized terms) used in this Notice have the same meanings given in the CCPA, unless otherwise defined.

1. Personal information we collect

We may collect information that identifies, relates to, describes, references, is capable of being associated with, or could reasonably be linked, directly or indirectly, with a particular Applicant or device ("Personal Information"). In particular, we may collect the following categories of Personal Information from Applicants who are subject to this Applicant Notice within the last twelve (12) months:

Sensitive Personal Information is a subtype of personal information consisting of specific information categories. While we collect information that falls within the Sensitive Personal Information categories listed in the table below, the CCPA does not treat this information as Sensitive Personal Information because we do not collect or use it to infer characteristics about Applicants.

QIAGEN obtains the categories of Personal Information listed above from the following categories of sources:

  • Directly from you. For example, when you submit your Personal Information to us through job applications. 
  • Indirectly from you. For example, from location-tracking enabled devices connected to QIAGEN assets you may use as part of the application process with QIAGEN.
  • From independent third parties related to your eligibility for employment, or our ongoing management of our business.
  • QIAGEN personnel, as part of QIAGEN’s management, evaluation, and hiring processes.

2. How We Use Personal Information – Our Business Purposes

A business purpose means the use of personal information for QIAGEN’s operational purposes or business needs that are reasonably necessary and proportionate to achieve the purpose for which your information was collected. QIAGEN uses and processes your Personal Information for our business purposes, primarily related to your application process with QIAGEN, including for one or more of the following:

2.1 To fulfill or meet the reason you provided the information. For example, if you share your name and contact information to apply for a job at QIAGEN.

2.2 To provide, support, personalize, and develop our application process.

2.3 To provide you with support and to respond to your inquiries.

2.4 To comply with legal obligations including the reporting requirements of the federal Equal Employment Opportunity Act, the federal Office of Contracting Compliance Programs (applicable to government contractors), and California’s Fair Employment and Housing Act, and the contractual requirements of QIAGEN’s clients.

2.5 To respond to law enforcement requests and as required by applicable law, court order, or governmental regulations.

2.6 To protect the security of QIAGEN’s physical locations and information systems.

2.7 Disclosures made in an effort to prevent or halt violations of QIAGEN’s policies, illegal activities, or as required by law.

2.8 Disclosures that we reasonably believe are necessary to defend against or prevent us from incurring liability to third parties.

3. Sharing of Personal Information

We may share your personal information with our other employees, contractors, consultants, and other parties (including our affiliates, subsidiaries, and related entities) for a business purpose. We may share your Personal Information in the following circumstances:

  • For Legal Obligation or Safety Reasons – When we have a good faith belief that access, use, preservation or disclosure of Personal Information is reasonably necessary to (a) satisfy or comply with any requirement of law, regulation, legal process, or enforceable governmental request, (b) enforce or investigate a potential violation of our policies and procedures, (c) detect, prevent, or otherwise respond to fraud, security or technical concerns, (d) support auditing and compliance functions, or (e) protect the rights, property, or safety of QIAGEN its users, or the public against harm.

  • In the Case of a Merger or Sale – If and when we are involved in a merger, acquisition, or any form of transfer or sale of some or all of its business, whether as a going concern or as part of bankruptcy, liquidation, or similar proceeding, Personal Information may be transferred along with the business. Where legally required we will give you prior notice and if you have a legal right to do so, an opportunity to object to this transfer.

  • With Service Providers and Contractors – When we hire a service provider to help operate our business, we may give access to Personal Information as necessary to perform the service for QIAGEN. This includes collecting Personal Information about you for the purposes described in this Notice. When we share personal information with such parties for a business purpose, we typically enter into a contract that describes the purpose and require that they only use or disclose such personal information in a manner consistent with the use and disclosure provisions of this Notice and our online Privacy Policy.

  • Affiliates – We may share your Personal Information with our affiliates, subsidiaries, and related entities for purposes consistent with this Notice.

  • Professional Advisors – We may disclose your Personal Information to professional advisors, such as lawyers, bankers, auditors, and insurers, where necessary in the course of the professional services that they render to us.

Further, your Personal Information may be disclosed:

  • as permitted or required by applicable law or regulatory requirements. In such a case, we will endeavor to not disclose more personal information than is required under the circumstances;
  • to comply with valid legal processes such as search warrants, subpoenas, or court orders;
  • as part of QIAGEN's regular reporting activities to other members of the QIAGEN Affiliates (including outside of your home jurisdiction);
  • to protect the rights and property of QIAGEN;
  • during emergency situations or where necessary to protect the safety of a person or group of persons; or
  • with your consent.

Disclosures of Personal Information

In the preceding twelve months, QIAGEN has disclosed some or all of the categories of Personal Information as noted above, for the business purposes described above.

Sale and Sharing of Personal Information

In the preceding twelve months, QIAGEN has not engaged in activities constituting the sale, lease, exchange, or disclosure of Personal Information to a third party for monetary or other valuable consideration, except as permitted by law. QIAGEN does not and will not sell personal information subject to this Notice.

4. Retention of your Personal Information

Except as otherwise permitted or required by applicable law or regulation, we will only retain your personal data for as long as necessary to fulfill the purposes we collected it for, as required to satisfy any legal, accounting, or reporting requirements, or as necessary to resolve disputes. In determining how long we retain your Personal Information; we take into account our Records Retention Policy, legal and regulatory obligations (such as legal requirements to retain your information, financial reporting obligations, and equal opportunity or anti-discrimination reporting obligations), the nature and sensitivity of the Personal Information, the potential risk of harm from unauthorized use or disclosure of the Personal Information, and whether we may need to retain the Personal Information to resolve disputes, make and defend legal claims, conduct audits, pursue legitimate business purposes and/or enforce our agreements.

Under some circumstances we may anonymize your personal data so that it can no longer be associated with you. We reserve the right to use such anonymous and de-identified data for any legitimate business purpose without further notice to you or your consent.

If you are offered and accept employment with QIAGEN, the personal data we collected during the application and recruitment process will become part of your employment record, and we may use it in connection with your employment consistent with our employee personal data policies. If you do not become an employee, or, once you are no longer an employee of QIAGEN, we will retain and securely destroy your personal data in accordance with our document retention policy and applicable laws and regulations.
